Terms of Business

The following general terms will apply to all matters handled on behalf of clients, unless otherwise agreed in writing

1        My Charges
My current hourly rate is £210.  The minimum charged for dealing with a single document is normally £70. I do not charge VAT on my charges although VAT may be included in any agent's fees and other out of pocket expenses. 

2        Estimates
Once I have seen any documents and any instructions sent to you about the document, I may be able to give you a firm indication or an estimate of the likely charges. 

3        Payments out on Your Behalf
I may have to pay legalisation fees to the Foreign and Commonwealth Office and/or a Foreign Embassy.  There might be agent’s fees or translator or interpreter fees.  Other payments may be required including travelling expenses.  Your approval to these will be obtained in advance 

4        Funds on Account
You will be required to make payment in advance of any such amounts. 

5        Basis of Charging
If it is a simple matter of witnessing a document, a fixed fee will be charged.  If there are complications or if I am required to draft a document, or obtain legalisation, the charge will be based upon time spent.  This may include telephone calls made or received, letters sent and received, time spent in interview, on drafting, and on preparing the necessary entries in my notarial register.  Special factors which might result in an increase in the charge include:
  • Complexity or novelty.
  • The number and importance of the documents.
  • If the work has to be done away from my office.
  • Special urgency which may require me to drop other work to deal with yours or if the work unavoidably has to be dealt with outside office hours.
 6        Payment
My charges as a Notary Public and any agent’s fees or other out of pocket expenses are normally payable upon signature of the document requiring notarisation and I reserve the right to retain any completed document until payment has been received.  

7        Interest
Interest is chargeable from the date of the invoice on invoices outstanding for more than seven days at 4% above Lloyds TSB Bank PLC base rate. 

8        Liability for Payment
Where a client requests that an invoice is to be paid by a third party on behalf of a client and such third party does not pay the invoice within 7 days of issue of invoice the instructing client will immediately be liable to discharge that invoice. 

9        Quality of Service
It is my aim to provide a good service to clients. Any client who has cause for dissatisfaction or complaint should immediately notify me. 

10      Confidentiality
I attach great importance to dealing with clients affairs in strict confidence. The professional body regulating my practice as a Notary Public also has rights of inspection to ensure good practice and conduct. 

11      Professional Indemnity
I maintain professional negligence indemnity insurance providing cover in the sum of £1 million which is in excess of the minimum requirements set by the Faculty Office of the Archbishop of Canterbury. Details are available upon request. 

12      Limitation of Liability
No liability for loss to clients not covered by the limits of my Professional Indemnity Insurance can be accepted. All liability arising out of legal actions instituted within the jurisdiction of the United States of America or Canada is specifically excluded.
